Welcome to tgfdesign! These Terms of Service (“Terms”) govern your use of the tgfdesign website and services. By accessing or using tgfdesign, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you may not use tgfdesign.
1. Services
tgfdesign provides a platform for browsing and purchasing graphic design services and products. Our services may change over time, and we reserve the right to modify, suspend or discontinue any part of tgfdesign at any time without notice.
2. Account Registration
To access certain features of tgfdesign, you may need to create an account. You agree to provide accurate and up-to-date information when creating an account. You are responsible for maintaining the confidentiality of your account login information.
3. Intellectual Property
tgfdesign owns all intellectual property rights in the website and its contents. You may not reproduce, distribute, modify, or create derivative works from any part of tgfdesign without our prior written consent.
4. User Content
By uploading or submitting any content to tgfdesign, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, distribute, and display that content in connection with operating tgfdesign.
5. Prohibited Conduct
You agree not to use tgfdesign in any way that violates applicable laws or regulations or infringes upon the rights of others. This includes, but is not limited to, uploading or transmitting content that is illegal, defamatory, or infringing on intellectual property rights.
6. Payment and Fees
tgfdesign may charge fees for certain services or products. You agree to pay all applicable fees and taxes. We reserve the right to modify our pricing at any time.
7. Disclaimers and Limitation of Liability
tgfdesign is provided on an “as is” and “as available” basis without warranties of any kind. We do not guarantee the accuracy, completeness, or reliability of any content or information on tgfdesign. To the maximum extent permitted by law, tgfdesign shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of tgfdesign.
8. Indemnification
You agree to indemnify and hold tgfdesign harmless from any claims, losses, liabilities, and expenses (including legal fees) arising from your use of tgfdesign or breach of these Terms.
9. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the United States of America and the State of Delaware. Any disputes arising from these Terms shall be resolved in the courts located in Wilmington, Delaware, United States of America. Additionally, your use of tgfdesign and any transactions shall comply with all applicable laws and regulations in Jamaica where the services are provided.
10. Changes to the Terms
We reserve the right to modify these Terms at any time. Your continued use of tgfdesign after any changes constitutes your acceptance of the revised Terms.
11. Refund Policy
At tgfdesign, we stand behind the quality of our work and strive to deliver excellent service to our clients. However, we understand that there may be instances where a client is dissatisfied with our services, and in such cases, we offer a fair refund policy.
11.1 Website Development
- If a client is unsatisfied with the website development project within 7 days of the initial deployment, they may request a refund of 50% of the total project cost. After 7 days, no refunds will be issued for website development projects.
- Refunds will not be granted for website maintenance, hosting, or domain registration services.
11.2 Graphic Design Services
- For graphic design projects, clients have 3 business days from the date of final design delivery to request a refund. If a refund is requested within this timeframe, a 75% refund of the project cost will be issued.
- After 3 business days, no refunds will be granted for graphic design services.
11.3 Refund Procedure
- To request a refund, clients must submit their request through our contact form or email austin@tgfdesign.io, clearly stating the reason for the refund and providing any relevant details.
- Refunds will be processed within 5-7 business days of the approved refund request.
- Refunds will be issued using the original payment method.
11.4 PSD Templates
- All PSD template purchases are final and non-refundable due to the digital nature of the product.
- Upon successful payment and delivery of the PSD template file, no refunds will be issued.
- We ensure the quality and usability of all PSD templates before making them available for purchase.
- If you experience technical issues accessing your purchased template, please contact our support team at austin@tgfdesign.io for assistance.
Please note that refunds will not be granted for projects that have been completed and delivered according to the agreed-upon specifications and requirements. Additionally, any refund requests made after the specified timeframes will not be considered.
